Feild Terms of Service

Rules and Regulations  

  • All dogs are required  to be up to date DH2PP vaccine or titre test.  
  • All dogs are to be free of fleas and parasites. Any dogs showing signs of parasites will not  be permitted back until providing proof of treatment.
  • This area is designed for owner who's dog(s) can not be with other dogs.  By agreeing to the terms if your dog has history of aggression with people or canine that your dog wear a muzzle upon exiting your vehicle until secured in the fenced in area.  Again muzzling your dog upon exiting the filed until secured in your vehicle.
  • Dogs that are currently ill or injured are not permitted. Owners certify by signing this  application that their dog is in good health.
  • We reserve the right to refuse any dog for any reason at anytime.
  • Kennel cough is a risk in a canine facility environment. Owners agree to take proper  precautions against contracting or spreading of Bordetella .
  • DO NOT enter the field until the field is empty of persons and canine.  Stay clear of the gate until the dog and people have passed.
  • Prompt clean up of bowel movements is expected.  It's a big field and we try to keep it very clean.  It is appreciated if you see poop that you pick it up.
  • NO DIGGING.  Any dogs digging anywhere besides the sand box will be asked to leave.  Feel free to bury treats in the sandbox to encourage digging in the sandbox.
  • Make sure all gates are securely fastened when coming and going.
  • Be cautious of uneven ground.  Dogs can dig a hole very quickly.  Please notify us if you find a hole while using the field.
  • No Smoking on property.

Representations, Warranties, and Acknowledgements  

A. I recognize that the health of my dog(s) is the owner’s responsibility. I hereby represent  that Rabies and DHPP vaccinations are up to date or have a titre test showing  immunity. I hereby agree to ensure my dog(s) remain protected against Rabies and  DHPP while attending Woof Pack.  

B. I hereby represent that my dog(s) is of good health and has not been ill with any known  contagious diseases within the past 30 days. 

C. I recognize kennel cough is a risk of contracting to my dog(s). I agree if my dog(s) show  any signs of kennel cough that its the owners responsibility to treat and contain.  D. I recognize parasitic treatment is the responsibility of the owner. I hereby represent  that my dog is free of parasites including but not limited to fleas, internal worms, and  mange. I agree to keep my dog(s) free of parasites with regular treatment. E. I represent and warrant that my dog has never injured or harmed any person or canine. F. I represent and warrant that my dog has never displayed or engaged in any aggressive  behaviours, saving and excepting those behaviours which would be considered typical or  normal during play, which a reasonable dog owner, fully informed and acting reasonably,  would permit and find reasonable while dogs are at play, and which would not result in  any harm or injury to any person or canine.I understand Woof Pack reserves the right to  permanently remove any dog from our care at any time for any reason. G. I agree that my dog(s) will be videotaped, photographed and recorded. Woof Pack shall  be the owner and all proceeds of such media. 

H. I acknowledge that Woof Pack fees and packages are non-refundable and non transferrable.

WAIVER, AGREEMENT AND RELEASE OF LIABILITY  

I have applied to have my dog attend Woof Pack K-9 Lifestyle Centre ("the Centre"), owned by  Woof Pack K-9 Lifestyle Centre Incorporated ("Woof Pack"), and my application has been  approved. In exchange for this approval, and as a condition of myself and my dog attending and  being a client of Woof Pack, I hereby confirm and agree as follows:  

1. WAIVER OF LIABILITY  

I release and forever discharge Woof Pack, its officers, directors, members, employees, agents,  affiliates, volunteers, sponsors, insurance brokers and insurers, (collectively, “Representatives”  and individually a “Representative”), jointly and severally, from any and all claims against one  or more of Woof Pack and its Representatives, including, but not limited to, claims for any injury  

or death arising from my attendance and my dog's attendance at the Centre. This waiver, release,  and discharge applies to all legal rights, including those resulting from any negligence of one or  more of Woof Pack and any Representative.  

2. COVENANT NOT TO SUE  

I, for myself, my heirs, family members, personal representatives and assigns, hereby covenant  and agree not to sue Woof Pack or any of its Representatives, jointly and severally, for any  claims (including, but not limited to, claims for injury or death) arising from my attendance and  my dog's attendance at the Centre. This covenant not to sue applies to all legal rights, including  those resulting from any negligence of one or more of Woof Pack and its Representatives.  

3. ASSUMPTION OF RISK  

I understand and acknowledge that my attendance and my dog's attendance at a place of business  highly populated with dogs involves risks. Serious injury to myself or my dog can result from  many causes, including but not limited to aggressive dog behaviour, dog bites, dogs getting in  fights, uneven ground during agility and training courses, or canine-related infections, injuries, or  diseases. I understand that the Centre's property contains some uneven terrain and acknowledge  that I could potentially suffer any manner of accidental injuries on the property. Injuries to  myself or my dog could be minor, such as bruises, scratches and sprains; or major, such as eye  injuries, broken bones and concussions. I understand these risks. I, for myself, and for my heirs,  family members, personal representatives and assigns, assume all risks and full responsibility for  any injury or death arising from my attendance and my dog's attendance at the Centre. For 

certainty, I acknowledge and confirm that I have been informed and am fully aware of all risks  involved in my attendance and my dog's attendance at the Centre.  

4. INDEMNIFICATION  

I agree to indemnify and hold harmless Woof Pack and its Representatives, jointly and severally,  from any claims, costs, damages, and liabilities, including lawyer’s fees, arising from my  attendance and my dog's attendance at the Centre. This duty to indemnify and hold harmless  Woof Pack and its Representatives applies even if one or more of Woof Pack and any  Representative is negligent.  

5. LEGAL ADVICE  

I know that I can talk to my legal advisor about this document and I have either done so or  declined to do so. I understand I have the right and have been given the opportunity to object to  and negotiate the provisions of this WAIVER, AGREEMENT AND RELEASE OF  LIABILITY. I am freely and voluntarily signing this WAIVER, AGREEMENT AND  RELEASE OF LIABILITY and intend it to be an unconditional release of all liability to the  greatest extent allowed by law.  

6. MISCELLANEOUS  

This WAIVER, AGREEMENT AND RELEASE OF LIABILITY is governed by the laws of  the Province of Nova Scotia, and I hereby irrevocably attorn to the jurisdiction of the Courts of  Nova Scotia. If any part of this WAIVER, AGREEMENT AND RELEASE OF LIABILITY is  held invalid, the rest of the provisions shall remain in effect.  

7. COVID-19 Waiver 

I attest that to the best of my knowledge, I do not have COVID-19 at the time of attending Woof  Pack, and I understand the risks of unknowing exposure to this and other illnesses by or to myself,  my family, other participants, and any third parties.  I agree that I  will not knowingly expose others to any illness I may have or be at risk to have. I will follow all the  facility rules and requirements to reduce any exposure and possibility of contracting or spreading  the virus. I will also fully cooperate with and follow any Municipal, Regional, Provincial and  Federal guidelines. I understand if I do not fully comply with the guidelines regarding COVID -19,  I will be required to leave the facility with no claim of a refund.
